Coaching terms, clearly explained.
These Terms & Conditions (“Terms”) govern the provision of coaching services by JP Golf Coaching (“JP Golf Coaching”, “we”, “us” or “our”) to the person purchasing or using those services (“you” or “the Client”).
By purchasing or subscribing to a coaching service, you confirm that you have read and agree to these Terms.
Nothing in these Terms affects your statutory rights as a consumer.
1. Our Services
1.1 JP Golf Coaching provides remote online golf coaching. Depending on the service or package purchased, this may include video swing analysis, technical instruction, practice planning, performance guidance and written, recorded or verbal feedback.
1.2 The exact features, frequency of feedback and level of support included will be those stated on our website or otherwise communicated to you at the time of purchase.
1.3 Coaching is delivered remotely unless expressly agreed otherwise in writing.
1.4 Golf performance depends on many factors outside our control, including practice, physical capability, playing conditions and implementation of coaching advice. We therefore cannot guarantee any particular improvement in performance, scores or handicap.
2. Eligibility, Health & Fitness
2.1 Unless otherwise agreed in writing, clients must be 18 years of age or over.
2.2 You are responsible for ensuring that you are physically capable of participating in golf practice and implementing the coaching provided.
2.3 You must inform us of any physical limitation or other relevant circumstance that may reasonably affect your ability to undertake suggested exercises or practice.
2.4 If you experience pain, injury or unusual discomfort, you should stop the relevant activity and seek appropriate medical or healthcare advice where necessary.
3. Coaching Memberships & Packages
3.1 Where membership places are limited, availability is offered on a first-come, first-served basis. JP Golf Coaching may limit the number of active coaching clients to maintain the quality of the service.
3.2 The price, duration, services included and any minimum commitment will be clearly stated before purchase.
3.3 Memberships and coaching packages are personal to the Client and may not be transferred or shared without our prior written agreement.
3.4 We may close a package or membership option to new customers or introduce new coaching options at any time. This will not remove services already purchased by an existing Client during an agreed fixed term.
4. Payments
4.1 Prices are stated in pounds sterling (GBP) unless otherwise indicated.
4.2 Payment may be collected through third-party payment providers. JP Golf Coaching does not directly store your full payment-card or bank-account details.
4.3 Where a coaching programme is paid by monthly instalments, those instalments are payments towards the agreed programme or membership and do not necessarily create a separate monthly contract.
4.4 If a payment is declined, reversed or remains overdue, we may temporarily suspend coaching after giving you a reasonable opportunity to resolve the payment issue.
4.5 You remain responsible for payments properly due under an agreed minimum-term programme, subject to your statutory rights and the cancellation provisions below.
5. Statutory Cancellation Rights
5.1 Where applicable under UK consumer law, a Client purchasing coaching online has a statutory 14-day cancellation period beginning on the day after the contract is entered into.
5.2 If you ask us to begin providing coaching during this 14-day period, you expressly request that the service begins before the cancellation period has expired.
5.3 If you exercise a statutory right to cancel after coaching has begun at your request, we may deduct or charge a proportionate amount for services already supplied, where permitted by law.
5.4 Where a service has been fully performed during the cancellation period following your express request to begin early and your acknowledgement that the cancellation right will be lost following full performance, your statutory cancellation right in respect of that fully performed service may cease.
5.5 Nothing in these Terms limits any cancellation, refund or other consumer right that cannot lawfully be excluded.
6. Fixed-Term Coaching Programmes
6.1 Where a coaching programme is advertised and purchased as a 3-month or 6-month programme, you are entering into a minimum-term coaching commitment for that period.
6.2 Any minimum term, total price and payment schedule will be made clear before you purchase.
6.3 Monthly instalments within a fixed-term programme are a payment arrangement and do not, by themselves, convert the programme into a month-to-month membership.
6.4 Subject to your statutory rights, a request to leave a fixed-term programme early will be considered in light of the circumstances and the services already provided or committed.
6.5 Where appropriate, we may agree to early termination because of circumstances such as long-term illness or injury preventing meaningful participation or serious personal hardship.
6.6 Requests for early termination should be made in writing. We may reasonably request supporting information where relevant.
6.7 Any amount retained or payable following early termination will be reasonable and will take account of services already supplied and losses or costs reasonably arising from the early termination. We will not impose a disproportionate cancellation charge.
7. Monthly Memberships
7.1 Where a service is expressly sold as a rolling monthly membership rather than a fixed-term programme, it will continue until cancelled in accordance with the cancellation terms disclosed at purchase.
7.2 Instructions for cancelling a rolling membership will be made reasonably accessible.
7.3 Cancellation does not affect payments already properly due or services already supplied.
7.4 Any applicable notice period or renewal arrangement will be disclosed before purchase.
8. Sessions, Assessments & Coaching Submissions
8.1 Where a service includes a scheduled live session, cancellation or rescheduling should normally be requested at least 24 hours before the agreed start time.
8.2 A live session cancelled with less than 24 hours’ notice, or missed without notice, may be treated as used where it was reasonable for JP Golf Coaching to reserve that time exclusively for you.
8.3 Where reasonable notice is provided, we will make reasonable efforts to reschedule a live session within the applicable coaching period.
8.4 For asynchronous coaching, including submitted swing videos, you are responsible for providing suitable footage and any information reasonably required for analysis.
8.5 Coaching reviews or submissions included within a package must normally be used within that package’s stated period unless otherwise agreed.
9. Cancellation or Interruption by JP Golf Coaching
9.1 We may occasionally need to delay, reschedule or interrupt coaching because of illness, technical failure or another circumstance outside our reasonable control.
9.2 Where a specific paid service cannot reasonably be provided, we will, as appropriate, reschedule it, extend the relevant coaching period, provide an equivalent service, or refund the amount attributable to the service that cannot be delivered.
9.3 We may terminate coaching where there is a material breach of these Terms, serious misconduct, abusive behaviour or persistent non-payment. Where appropriate, we will give reasonable notice and an opportunity to remedy the issue before termination.
10. Communication & Response Times
10.1 Coaching communication will take place through the platforms and channels specified for the package purchased.
10.2 Any indicative response time represents our normal service objective rather than a guarantee unless expressly stated otherwise.
10.3 Response times may occasionally be affected by weekends, holidays, illness, travel, workload or technical problems.
10.4 Access to the Coach is limited to the level of support included in the purchased service. Unless expressly included, a coaching package does not provide unlimited or continuously available communication.
11. Client Responsibilities & Conduct
11.1 Successful coaching requires active participation. You remain responsible for your practice, playing decisions and implementation of coaching advice.
11.2 You agree to communicate respectfully and to use the coaching service reasonably.
11.3 Abusive, threatening or seriously inappropriate behaviour may result in suspension or termination of the coaching relationship.
11.4 You are responsible for ensuring that your practice environment is reasonably safe and that golf clubs, training aids and other equipment are used appropriately.
12. Health & Coaching Disclaimer
12.1 JP Golf Coaching provides golf coaching and does not provide medical diagnosis, physiotherapy, rehabilitation or other healthcare services.
12.2 Any discussion of movement, mobility or physical capability is provided solely in the context of golf coaching and should not be treated as medical advice.
12.3 Coaching does not replace advice or treatment from an appropriately qualified healthcare professional.
13. Intellectual Property
13.1 Unless otherwise stated, coaching videos, analysis, drills, written materials, practice plans and other materials created and supplied by JP Golf Coaching remain our intellectual property.
13.2 You are granted a personal, non-exclusive licence to use those materials for your own golf development.
13.3 You may not reproduce, publish, sell, commercially exploit or distribute our coaching materials to third parties without prior written permission.
13.4 You retain ownership of swing videos, photographs and other original material that you submit to us. You grant JP Golf Coaching permission to use that material as reasonably necessary to provide the coaching service.
14. Privacy, Confidentiality & Client Media
14.1 Personal information will be handled in accordance with applicable data protection legislation and our Privacy Policy.
14.2 Coaching information and communications will be treated with appropriate confidentiality, subject to any legal obligation requiring disclosure.
14.3 We will not use identifiable client swing videos, photographs, testimonials or other personal media for public marketing or promotional purposes without obtaining appropriate permission.
14.4 Where consent is the legal basis for such marketing use, you may withdraw that consent for future use by contacting us.
15. Liability
15.1 JP Golf Coaching will provide its services with reasonable care and skill.
15.2 Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or your statutory consumer rights.
15.3 Subject to clause 15.2, JP Golf Coaching is not responsible for losses that were not reasonably foreseeable when the contract was entered into or for losses resulting from circumstances outside our reasonable control.
15.4 JP Golf Coaching is not responsible for business losses incurred by a Client purchasing coaching wholly or mainly for personal purposes.
15.5 You remain responsible for deciding when, where and how to practise and play and for following appropriate safety precautions.
16. Events Outside Our Reasonable Control
16.1 We will not be responsible for delay or failure to provide a service where this results from circumstances outside our reasonable control.
16.2 Where such circumstances materially affect an ongoing coaching programme, we will take reasonable steps to minimise disruption and communicate with affected Clients.
17. Changes to These Terms
17.1 We may update these Terms where reasonably necessary, including to reflect changes in law, payment systems, technology or the way our services operate.
17.2 Changes will not retrospectively remove contractual rights already acquired by a Client.
17.3 Where a material change affects an existing ongoing service, we will provide reasonable notice. If the change materially disadvantages you, any cancellation rights available to you will be explained at that time.
18. Complaints
18.1 If you are dissatisfied with any aspect of the coaching service, please contact us using the email address below.
18.2 We will aim to investigate and respond to complaints fairly and within a reasonable period.
18.3 Nothing in this complaints procedure affects your statutory rights.
19. Governing Law
19.1 These Terms are governed by the laws of England and Wales.
19.2 If you are a consumer resident elsewhere in the United Kingdom, you may also have rights under the mandatory laws applicable where you live.
19.3 Any dispute may be brought before the courts having jurisdiction under applicable consumer law.
